Uphold the Constitution: Restore the rights of Indigenous Peoples, Pass the Indigenous Peoples Law
A decade of Joko Widodo’s (Jokowi) regime has left a legacy of sins to Indigenous Peoples. The regime has betrayed the 1945 Constitution, broken its political promises and failed to protect the people. There is no good faith shown by the government for the interests and alignment of Indigenous Peoples. In fact, most government policies are orientated towards expanding and strengthening the business sector. Power has been used in such a way as to perpetuate the interests of the oligarchy.
The above problems are evidenced by the existence of various legal products such as the revision of the Minerba Law, the CK Law, the IKN Law, the ratification of the Criminal Code Law. These laws and regulations were designed and passed deliberately to deny the existence of more than 40 million Indigenous Peoples and their constitutional rights (AMAN, 2023). The state continues to put forward legal scenarios that have the character of dispossessing and oppressing Indigenous Peoples. This is reflected in the complicated, convoluted and sectoral policies on legal recognition of indigenous peoples and their territories.
